About This Schedule

This page reproduces the 2026 Riverside County Superior Court Felony and Misdemeanor Bail Schedule, effective January 1, 2026. The schedule was adopted by the Riverside County Superior Court and implemented beginning October 24, 2025. Source document: 2026 Felony and Misd Bail Schedule_ADA_8_ADA_1_1.pdf, Riverside County Superior Court.

Release Protocol Categories

Each offense in this schedule is assigned one of four release protocol categories. The category determines how a defendant is processed after arrest. Definitions, exceptions, and the PAR implementation note below are reproduced from the official 2026 Riverside County Felony and Misdemeanor Bail Schedule, Pages 1–2.

CRCite & Release

The arresting agency shall cite and release the arrestee. The arrestee shall be given a written promise to appear in court at a date and time specified by the arresting agency. The arresting agency shall not book the arrestee.

Exception (Rule 3):

CR does not apply if other factors exist — including a prior failure to appear or other holds apart from the current arrest that would prohibit release. If other factors exist, the arresting agency shall advise accordingly and the offense category changes to PAR.

BRBook & Release

The arresting agency shall book the arrestee and release the arrestee on a written promise to appear in court at a date and time specified by the arresting agency. No bail is required.

Exception (Rule 3):

BR does not apply if other factors exist — including a prior failure to appear or other holds apart from the current arrest that would prohibit release. If other factors exist, the arresting agency shall advise accordingly and the offense category changes to PAR.

PARPre-Arraignment Review

The arresting agency shall book the arrestee. The arrestee shall be held in custody pending a bail review by a magistrate or the court. The arrestee may be released on bail in the amount set in the bail schedule for the offense, or on such other conditions as the magistrate or court may impose.

PAR Implementation Note (from the official schedule):

The Riverside County Superior Court is in the process of implementing the Pre-Arraignment Review (PAR) offense category. Until implementation is complete, offenses designated PAR shall be treated as Arraignment Review (AR) offenses. The bail amount for PAR offenses shall be the amount set forth in this bail schedule.

ARArraignment Review

The arresting agency shall book the arrestee. The arrestee shall be held in custody without bail until arraignment, at which time the court shall set bail or release conditions. No bail may be posted prior to arraignment except as authorized by the court.

Full rule text governing these categories — including multiple-count rules, unlisted offenses, and bail deviations — is in the Release Protocol Rules below.

Release Protocol Rules

Source: Riverside County Superior Court 2026 Felony and Misdemeanor Bail Schedule, Pages 1–4.

Rule 1: Setting Bail

A. Bail for felony crimes will be set as follows:

  1. The amount set in the approved arrest warrant;
  2. The amount set pursuant to Penal Code 1269c (see Rule 6(A) herein);
  3. The amount set at a hearing in court; and/or
  4. The amount set through use of this Bail Schedule.

B. To calculate bail on any one case, take the count that imposes the longest term of incarceration, find the offense category and (if applicable) the bail amount from the relevant Bail Schedule section. Confirm there is no exception to the offense category set forth in these Rules. Next, add bail for all applicable enhancements.

Rule 2: Multiple Cases

A. Multiple Counts in a Single Case: If an individual is arrested on two or more counts with different offense categories designated herein, the strictest offense category applicable to the arrestee's alleged offenses determines the release protocol for that arrestee.

B. Multiple Cases: Determine the offense category and, if applicable, the bail amount, for each case separately, including all applicable enhancements. A separate determination is required for each separate case.

Rule 3: Offense Category Exceptions

CR and BR offense categories do not apply if other factors exist. Other factors include a prior failure to appear or other holds apart from the current arrest, which would prohibit release. If other factors exist, the arresting agency should advise what other factor(s) exist with respect to an arrestee. Upon advisement that other factors exist, the offense category changes to PAR.

Rule 4: Enhancements/Strikes

A. Enhancements: The bail amount specifically described for each applicable enhancement shall be added cumulatively to the bail (if any) set forth for the specified offense.

B. Strikes: Where it is alleged in the Complaint or Information, or it is evident from other information made available to the Court, that there is a strike prior within the meaning of Penal Code Sections 667 and 1170.12, additional bail shall be calculated per the Priors & Sentencing Enhancement section of this Bail Schedule.

Rule 5: Unlisted Offenses

A. Unlisted Felonies/Enhancements: All felonies not listed in this bail schedule have an offense category of PAR. Presumptive bail is set at the middle term multiplied by $10,000. All enhancements not listed in this bail schedule have an offense category that is the same as the underlying offense. Presumptive bail is set at the term of the enhancement multiplied by $10,000 or the middle term of the enhancement, if one is provided, times $10,000.

B. Unlisted Attempts: Any attempt under Penal Code 664(a) that is not specifically listed in the bail schedule falls under the same offense category as the completed crime. The presumptive bail amount for such attempts is one half (1/2) the amount of the completed crime set forth in this bail schedule.

C. Unlisted Misdemeanors: All misdemeanors not listed in this bail schedule have an offense category of CR. Unlisted misdemeanors with a sentencing range of 180 days or less have a presumptive bail amount of $2,500. Unlisted misdemeanors with a sentencing range of 181+ days have a presumptive bail amount of $5,000.

Rule 6: Bail Deviations/Source of Bail Funds

A. Bail Deviations (1269c P.C.): In the event that a magistrate approves a bail deviation per 1269c P.C., any magistrate approved form must be filed with the Complaint.

B. Source of Bail Funds (1275.1 P.C.): In the event that a magistrate approves an application per 1275.1 P.C., the approved form must be filed with the Complaint or filed with the court if the complaint has already been filed.

Rule 7: Reproductive Rights

Pursuant to Penal Code section 1269b(f)(2), any person arrested in California in connection with a proceeding in another state regarding an individual performing, supporting, or aiding in the performance of an abortion in California, or an individual obtaining an abortion in California, if the abortion is lawful under the laws of this State shall not be held in custody and shall be immediately released on $0 bail.

POST IT BAIL BONDS — PRACTICAL NOTES

These notes reflect our experience posting bail in Riverside County and are not a substitute for the official rule text above.

  • Bail amounts in this schedule are presumptive — a judge may increase, decrease, or deny bail based on the facts of the case.
  • When a defendant faces multiple charges in a single case, bail is calculated on the one count that carries the longest incarceration term — not stacked per count. Enhancements are then added on top of that base amount.
  • Enhancements listed in the schedule are added on top of the base bail amount for the underlying offense.
  • For offenses not listed, the General Bail Chart (below) applies using the mid-term incarceration length.
  • Post It Bail Bonds posts bail at Riverside County jails 24/7. Call (951) 224-9327 for immediate assistance.
